We are AGENTIC VISION LTD (trading as VidComply) (“VidComply,” “we,” “our,” or “us”). This Privacy Policy explains how we collect, use, disclose, and protect personal information that applies to our website (the “Website”), our enterprise cloud-based AI compliance platform (the “Platform”), and all related services we provide (together, the “Service”).

Because VidComply is a B2B enterprise platform, we predominantly act as a Data Processor on behalf of our commercial clients (the Data Controllers). In these cases, our processing of your data is governed strictly by the Master Services Agreement (MSA) and Data Processing Agreement (DPA) executed with that client.

2. Personal Information We Collect

(a) Information you provide us directly

When you register for an account or communicate with us, we collect information such as your name, email address, corporate contact details, and login credentials. We also collect the content you submit to the Service, including video and audio recordings, metadata, and the resulting compliance reports generated (together, “Content”).

(b) Information we collect from you automatically

When you visit the Service, we automatically collect certain information regarding your usage to ensure platform security and reliability. This includes:

• Log File Information: Your web request, IP address, browser type, referring/exit pages, and interactions with the Platform.
• Cookies and Similar Technologies: We use strictly necessary cookies to keep your session secure, authenticate your identity, and remember your platform preferences.
• Device Identifiers: Information about the device and operating system used to access our secure environment.

3. How We Use Your Information

We use the information we collect strictly to operate our enterprise B2B Service. We do not use your data for consumer advertising or data brokering. Our uses include:

• Providing the Service: To perform ingestion, storage, analysis, and compliance verification of video content using our automated tools.
• Platform Security & Fraud Prevention: To monitor for unauthorised access, enforce Multi-Factor Authentication (MFA), and ensure the integrity of our isolated cloud environments.
• Communication & Troubleshooting: To send you technical alerts, resolve issues, and provide administrative notifications regarding your account.
• Strict AI Training Restriction: VidComply maintains a strict data boundary. We explicitly do not use your Content, proprietary data, or media assets to train, retrain, or improve our base Artificial Intelligence (AI) or Machine Learning (ML) models. We also contractually prohibit our sub-processors from doing so.

4. How We Share Your Information

We do not sell your personal data. We share data only with strictly vetted, enterprise-grade third-party sub-processors who are bound by strict confidentiality and data protection agreements. These categories include:

• Cloud Infrastructure Providers: To provision the isolated storage and dedicated compute instances required for your processing workflows.
• Authentication Providers: To manage secure user identity and access control.
• Enterprise AI & API Partners: Utilised strictly for optional, advanced compliance processing tasks, such as natural language processing or advanced metadata analysis.
• Administered Accounts: If you use the Service with an email address associated with your employer or organisation (the “Admin Entity”), your account is an “Administered Account.” We may share your name, email address, and account activity with the Admin Entity. The Admin Entity’s administrator may access, transfer, or delete your Administered Account and all Content associated with it.

5. Data Security and Infrastructure

VidComply employs enterprise-grade security measures tailored for broadcast media.

• Data Isolation: All client content is processed within dedicated, logically isolated cloud environments. We do not utilise cross-tenant resource sharing for core compute or storage.
• Encryption: All data and compliance reports are encrypted at rest using AES-256 and in transit using TLS 1.2+.

6. Data Retention

We retain personal information only for as long as your account is active or as needed to provide you with the Service. Upon termination of our commercial agreement, or upon written request by the Data Controller, we will securely delete all client-owned video assets and associated personal data from our primary storage within thirty (30) days, unless applicable law requires prolonged retention.

7. Additional Information for Users in Europe (GDPR / UK GDPR)

If you are located in the European Economic Area (EEA), Switzerland, or the United Kingdom (UK):

• Controller vs. Processor: For the user account data of our direct clients, VidComply acts as the Data Controller. For the Content uploaded to the Platform for processing, VidComply acts as a Data Processor on behalf of our commercial customers.
• International Transfers: To provide low-latency processing, your data may be transferred to and processed in the UK, the United States, or regional cloud infrastructure hubs (such as AWS Asia Pacific). We ensure all international transfers are safeguarded by Standard Contractual Clauses (SCCs) or equivalent legal mechanisms.
• Your Rights: You have the right to access, correct, delete, restrict, or object to the processing of your personal data.

8. Additional Information for Users in the United States

If you are a resident of certain U.S. states (including California), applicable state privacy laws may grant you additional rights regarding your personal information. VidComply does not sell or share your personal information for cross-context behavioural advertising. You have the right to request access to, correction of, or deletion of your personal information by contacting us directly or routing the request through your Admin Entity.

9. Changes to this Policy

We may update this Privacy Policy from time to time. If we make material changes, we will revise the “Last Updated” date at the top of this Policy and notify active clients via email or platform notification.
